By accessing or using the Loggers' Playday Parade website ("Website"), operated by the Hoquiam Elks Lodge #1082 and Ross Dynamics LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Website.

These Terms apply to all visitors, users, and others who access or use the Website, including those who register accounts, submit parade applications, or use any interactive features.

The Website provides information about the annual Hoquiam Loggers' Playday Parade event and offers the following services:

4. Parade Applications

4.1 Application Submission

By submitting a parade entry application, you represent and warrant that:

  • All information provided is accurate and complete
  • You have the authority to submit the application on behalf of your organization (if applicable)
  • Your entry complies with all applicable laws and regulations
  • Your entry does not contain inappropriate, offensive, or dangerous content

4.2 Application Review

All applications are subject to review and approval by the parade organizing committee. We reserve the right to:

  • Accept, reject, or request modifications to any application
  • Limit the number of entries in any category
  • Assign parade positions at our discretion
  • Cancel or modify the event due to circumstances beyond our control

4.3 No Guarantee of Participation

Submission of an application does not guarantee acceptance into the parade. Acceptance is at the sole discretion of the organizing committee.

5. User Conduct

You agree not to use the Website to:

  • Violate any applicable laws or regulations
  • Submit false, misleading, or fraudulent information
  • Impersonate any person or entity
  • Interfere with or disrupt the Website or servers
  • Attempt to gain unauthorized access to any portion of the Website

6. Intellectual Property

The Website and its original content, features, and functionality are owned by Ross Dynamics LLC and the Hoquiam Elks Lodge #1082 and are protected by copyright, trademark, and other intellectual property laws.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ROSS DYNAMICS LLC, HOQUIAM ELKS LODGE #1082, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR PARTICIPATION IN THE PARADE EVENT.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE WEBSITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Ross Dynamics LLC, Hoquiam Elks Lodge #1082, and their officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

  • Your violation of any rights of a third party
  • Your participation in the parade event

Any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Grays Harbor County, Washington.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the Website and supersede any prior agreements.
